1. Introduction

Welcome to MTM Tooling ("Company", "we", "our", "us"), a brand operated by Badshah Tools.

These Terms and Conditions ("Terms") govern your use of our website at carbidemtmtooling.com (the "Website") and our mobile application (the "App") — together, the "Service".

Our Privacy Policy also governs your use of the Service and explains how we collect and handle your information. Together, the Terms and the Privacy Policy form your agreement with us ("Agreement"). By using the Service, you confirm you've read and agree to the Agreement.

2. Communications

By using the Service, you may receive newsletters, order updates, and promotional material from us. You can opt out of marketing communications anytime via the unsubscribe link or by emailing customercare@carbidemtmtooling.com (transactional/order-related emails will still be sent).

3. Accounts

• You must be at least 18 years old to create an account or use the Service.
• Information you provide must be accurate, complete, and kept up to date.
• You're responsible for keeping your login credentials confidential and for all activity under your account.
• Notify us immediately of any unauthorized use of your account.
• We may refuse service, suspend or terminate accounts, or cancel orders at our discretion, including for breach of these Terms.

4. Account Deletion

You may delete your account at any time:

• In the App, via Settings → Delete Account.
• On the Website, by emailing info@carbidemtmtooling.com.

Deletion removes your profile and account data. Order/invoice records required for GST and tax compliance may be retained for the legally mandated period even after account deletion, as described in our Privacy Policy.

5. Orders, Pricing & Payments

• All product prices are listed in INR and subject to change without notice.
• Orders are subject to acceptance and product availability.
• Payments are processed by third-party, PCI-DSS-compliant payment processors; we do not store your card details.

6. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable law or regulation
• Harm or exploit minors
• Send spam, chain letters, or unauthorized advertising
• Impersonate the Company or any other person/entity
• Infringe on others' rights, or act fraudulently or unlawfully
• Interfere with, overburden, or damage the Service (including via bots, scraping, malware, or denial-of-service attacks)
• Attempt unauthorized access to our systems or those of other users

7. Content

If the Service allows you to post or submit content (e.g. reviews, images), you retain ownership, but you're responsible for its legality and accuracy, and you grant us a license to use, display, and distribute it in connection with the Service. We may remove content or terminate accounts that infringe on others' rights.

8. Intellectual Property

The Service and its original content (excluding user-submitted content), features, and functionality are the exclusive property of Badshah Tools and its licensors, protected under Indian and applicable international copyright and trademark law. The "MTM Tooling" name, logo, and trade dress may not be used without our prior written consent.

9. Copyright / DMCA-Style Complaints

If you believe content on the Service infringes your copyright, email customercare@carbidemtmtooling.com with the subject "Copyright Infringement" and include:

• Your contact details and signature (physical or electronic)
• A description of the copyrighted work and where the infringing material appears on the Service
• A good-faith statement that the use is unauthorized
• A statement, under penalty of perjury, that the information is accurate and you're authorized to act

Misrepresenting infringement may make you liable for damages, including our legal costs.

10. Disclaimer of Warranty

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or free of harmful components. This doesn't affect any warranties that can't be excluded under applicable law.

11. Limitation of Liability

To the extent permitted by law, Badshah Tools and its officers, employees, and agents won't be liable for indirect, incidental, special, punitive, or consequential damages arising from your use of the Service. Where liability can't be excluded, it's limited to the amount you paid for the relevant product/service.

12. Governing Law

These Terms are governed by the laws of India. If any provision is found invalid or unenforceable, the remaining provisions stay in effect. Disputes are subject to the exclusive jurisdiction of the courts at Indore, Madhya Pradesh.

13. Changes to Terms & Service

We may amend these Terms or modify/withdraw the Service at any time. Continued use after changes take effect means you accept the revised Terms. We recommend reviewing this page periodically.
